We have distilled more than 25
years experience as a court-appointed Receiver in Arizona into a suggested
form of Order that addresses the myriad of the issues we ran into in our
dealings with different types of property, from an urban adult nightclub to
a rural cinder mine. As technology changed we have had to adapt and change
along with it which is why we now include a requirement that Defendants turn
over items such as computer passwords. The sample form of Order is updated
every time we feel a need due to changing circumstances. (The revision date
appears at the end of the document.)
When one accepts responsibility for
operation of a receivership estate there's a lot more to it than simply
collecting rents and keeping records. One must be knowledgeable in the law
and know how and when to wield the power of the court that goes along with
the assignment. Having a clear understanding of what's required of all
parties - which is the function of the Order - is imperative. That's why
we’re willing to share our form of Order with other Receiver's and their
attorneys. Use it at your own risk and peril. We make no claim for it other
than it’s how we do it. It works well for us.
